Appeal from an order of the Supreme Court (Aulisi, J.), entered August 17, 2007 in Clinton County, which granted petitioner’s application pursuant to Workers’ Compensation Law § 29 (5) for judicial approval, nunc pro tunc, of a personal injury settlement.
In 2002, Gary E. Lautenschuetz (hereinafter decedent) com*949menced a personal injury action seeking damages for injuries he sustained from the inhalation of asbestos. He also filed a disability claim for workers’ compensation benefits and, when decedent died from mesothelioma in September 2003, petitioner, decedent’s wife, filed a death claim.…
