At 9:30 p.m. on July 13, 1985, the automobile which defendant was driving crossed the center line of State Route 7 in the Town of Conklin, Broome County, and collided head on with another vehicle, killing its driver, 34-year-old Tonia Dillenbeck, and injuring Dillenbeck’s 12-year-old son. Defendant was indicted and charged with second degree manslaughter, vehicular manslaughter, third degree assault, second degree reckless endangerment and operating a vehicle while under the influence of alcohol.
