MEMORANDUM

RAMBO, District Judge.

Before the court is plaintiff’s motion for a preliminary injunction seeking to enjoin defendant, a former franchisee of plaintiff, from 1) use of plaintiff’s service marks and 2) from engaging in a competitive business with plaintiff per a restrictive covenant in the franchise agreements. The court held a hearing on this motion on January 30, 1992 at which both parties presented their respective cases.
