¶ 1. John Andrew Casey appeals his conviction for aggravated assault of his then girlfriend, Lauren Brocato. "While his first trial resulted in a mistrial on this charge, he was convicted of aggravated assault after a second trial. Casey now appeals citing Rule 403 1 and claims the judge should have excluded evidence that during the assault he caged Lauren in a dog crate before wrapping her in a chain.
