Appeal from an order of the Appellate Division of the Supreme Court in the fourth judicial department, entered January 27, 1899, which reversed a judgment in favor of plaintiff, entered upon a verdict and an order denying a motion for a new trial, and granted a new trial. The nature of the action and" the facts, so far as material, are stated in the opinion. The defendants were not released from their liability under the guaranty by the extensions of payment.

On February 20,1889, Cornelia Hall executed and delivered to George L. Parker her bond, conditioned for the payment of four thousand dollars on February 28, 1892, with interest payable semi-annually, and as security therefor a mortgage of certain lands in the county of Orange. George L. Parker, on July 19, 1889, assigned the said bond and mortgage to Sarah 0. Parker. On such assignment the defendants, by a separate instrument under seal, guaranteed to Sarah 0.
