BINGHAM, Circuit Judge.

This is an appeal from a decree of May 24, 1934, of the Federal District Court for Massachusetts, enjoining the defendant-appellant, receiver of the Federal National Bank of Boston, Mass., from asserting any right in or to a certain check dated December 14, 1931, payable to the order of the Federal National Bank “a/c Lawrence Trust Co. Commercial Account,” for the sum of $2,554.50, of which Lapham, Potter & Holden were the makers. The plaintiff Brennan and'the receiver are the only parties before this court.
