MEMORANDUM
MERHIGE, District Judge.
This action is before the Court on the Defendant’s Motion to Withdraw the Reference of this action to the bankruptcy court. The Defendant also has asked that the Court rule on its request for a jury trial.
BACKGROUND
The Complaint alleges that National Enterprises, Inc. (“NEI”) and The Koger Partnership (“Koger”) are parties to a lease agreement, dated June 28, 1990, under which Koger leased to NEI a piece of property.
