This case, coming recently to the writer, is claim for preference asserted by the Commissioner of Finance on behalf of the Holland Banking Company, an insolvent bank in his hands for liquidation, against the Mt. Vernon Bank, also an insolvent bank in his hands for liquidation. The facts were stipulated and the judgment, which contains a statement of all the agreed facts, was as follows:
