I. Introduction

Plaintiff brings this action pursuant to 42 U.S.C. § 1981, 42 U.S.C. § 1983, and 42 U.S.C. § 1985 for alleged violations of civil rights secured by the United States Constitution. He also asserts claims under state law. Pending before the Court are plaintiffs objections to the Report and Recommendation of the Magistrate Judge (doc. no. 38), plaintiffs Motion for Eviden-tiary Hearing (id.) and defendants’ Response (doc. no. 40).
