Appeal from an order of the probate court apportioning the federal estate tax.

Morris Buekhantz died testate on March 18, 1950, and his will was admitted to probate. All property in which Buekhantz had an interest was community property of himself and his wife, Jeannette. The will disposed of all the community property and required Jeannette to elect whether she would accept the provisions of the will or “the rights which might be given her by law. ’ ’ It bequeathed and devised the property to Jeannette, a sister, various relatives, employees and charitable institutions.
