Plaintiff Walter Canning sued on August 19, 1960, for damages for medical expenses, loss of earnings, and impairment of earning capacity, and pain and suffering allegedly resulting from injuries sustained when the car which he was driving was struck from the rear by a car driven by defendant Stephen Hannaford with permission of the owner, defendant Gerald Hannaford. The car driven by plaintiff was owned by Henze Machine & Tool Company, a Michigan partnership, of which plaintiff and his brother were the only partners.
