Appeal from circuit court, New York county. Action by John H. Graham and another against 'William I. Negus and another, to recover the price of goods sold by plaintiffs to defendants. From a judgment in favor of defendants, plaintiffs appeal.

The complaint alleged the sale óf goods by the plaintiffs to the defendants between the 1st of July, .1887, and the last day of January, 1888, amounting to the sum of $2,745.40; and it was alleged that there was due and'owing upon this amount, at the time of the commencement of the action, $2,527.55, with interest from the 15th of October, 1887. The answer did not deny the sale and delivery of the goods by the plaintiffs to the defendants, but it alleged that the goods were sold on credit, which had not expired' at the time of the commencement of the suit.
