The orator on the 21st of June, 1858, being the assignee of the interest of the firm of Fox, Henderson & Co., in certain claims for damages growing out' of certain alleged breaches of a contract for the manufacture and delivery of twenty-five thousand Minie rifles, originally made with that firm by 'the Robbins & Lawrence Company, and subsequently assumed by the Union Arms Company, commenced a suit in the county court of the county of Windsor, in the name of Charles Fox as surviving partner of that firm, against the Union Arms Company, declaring upon the said breaches, and the writ in this…
