This case comes into this court by petition in error from the district court of Nuckolls county. On the 20 th day oí October, 1888, the defendant in error, Leonard K. Scrog-gin, filed in said court his petition in which he alleges in substance that he is the owner of certain live stock and farm implements then in the possession of the plaintiff in error McClelland upon land owned by him, Scroggin, in said county.
