The parties will be designated plaintiff and defendants, the same as below. This case comes from the district court of Carter county, and is an action to set aside a deed alleged to have been obtained by fraud, alleging that said deed is void for want of consideration; and, further, that the contract for the execution of the deed was entered into and made at a time when the plaintiff was less than 18 years of age. The evidence shows that Littie Hickman, the mother of plaintiff, Carsey Baken, died in 1903, before allotment, and Lyman Baken filed on the land in…
