Suit by the appellee against the appellant. It is alleged in the complaint that the plaintiff sold and delivered to the defendant, on the 26th day of September, 1873, forty-two hogs, at four dollars per hundred pounds, and that the defendant agreed to execute and deliver to the plaintiff his promissory note for three hundred and twenty-eight dollars for said hogs, payable on the 25th day of December, 1873, but failed and refused to do so, or to pay said sum of three hundred and twenty-eight dollars, or any part thereof, and that said sum remains due and unpaid; wherefore, etc.
