Appeal by defendant from a judgment of the Supreme Court, Richmond County (Owens, J.), rendered March 12, 1981, convicting him of rape in the first degree, sodomy in the first degree (two counts), sexual abuse in the first degree, and assault in the second degree, upon a jury verdict, and imposing sentence. Judgment reversed, on the law and the facts and as a matter of discretion in the interest of justice, and new trial ordered.
