Appeal by defendant from a judgment of the Supreme Court, Richmond County (Owen, J.), rendered January 26, 1981, convicting him of assault in the second degree, upon a jury verdict, and imposing sentence. Judgment reversed, as a matter of discretion in the interest of justice, and new trial ordered. Defendant’s conviction for assault in the second degree arose out of an incident which occurred during the early morning hours of June 28,1978. The People’s case was based primarily on the testimony of the complainant and her friend, both of whom were working in a late-night donut shop at the time…
