Appeal from a judgment of the general term of the supreme court, affirming a judgment of the court of general sessions, in and for the city and county of New York, entered upon a verdict convicting defendant of the crime of forgery in the second degree.

The defendant was convicted in the court of general sessions, in the city of New York, of the crime of forgery in the second degree, committed by uttering a forged check, knowing it to be forged. Prior to his conviction one Gaylord had been convicted of the same offense for uttering the same check, and.had been sentenced to the state prison at Sing Sing. He was produced as a witness on the trial of the defendant, and testified that he received the forged check from him, and was induced by him to attempt to obtain the money upon it from the bank upon which it was drawn.
