The representation charged in the indictment was, in substance, that the defendant’s firm of Hirsch & Mayer had, on the 1st of January, 1876, balanced its books and taken an account of stock, and that its assets, consisting of cash, merchandise, bills receivable and live accounts, exceeded its liabilities by the sum of $25,000. The prosecutor testified, to the making of the representations by Mayer, on the 28th of January, 1876, and to the sale of goods to Hirsch & Mayer on that day, on the faith of such representations.
