United Fire and Casualty Company (United) appeals from a judgment entitling David Kap- pus to recover underinsured motorist benefits from United in the amount of $62,524.93. 1 Pursuant to a jury verdict in favor of the Kappuses, American Family Mutual Insurance Company (American Family), the tortfeasor's insurance carrier, paid its $50,000 liability limits. The Kappuses, thereafter, agreed to divide the $50,000 equally between them. United argues that the trial court erred when it bound United to the agreement between the Kappuses — an agreement to which United was not a party. United further…
