MEMORANDUM AND ORDER
STROM, District Judge.
Plaintiff, Omaha National Bank (ONB), commenced this action on December 9, 1985, against defendant Citibank (South Dakota), N.A. (Citibank), claiming violations of the Trademark Act of 1946, as amended, 15 U.S.C. §§ 1114(1) and 1125(a); state trade name infringement under Neb. Rev.Stat. § 87-216 (1943), as amended; violation of the Nebraska Uniform Deceptive Trade Practices Act, R.R.S. 1943, as amended, § 87-301, et seq.; and common law service mark infringement.
