In 1995 the Environmental Protection Agency (“EPA”) promulgated standards pursuant to the Clean Air Act governing the combustion of municipal solid waste (“MSW”). See Standards of Performance for New Stationary Sources and Emission Guidelines for Existing Sources: Municipal Waste Combustors, 60 Fed.Reg. 65,387 (1995). The standards addressed the emissions of various substances and mixtures such as mercury and hydrogen chloride.
