PUTNAM, Circuit Judge.

One question involved relates to the jurisdiction taken by the court in bankruptcy over an alleged sale of a stock of merchandise which came into the hands of the receiver of a bankrupt’s estate. The other question relates to the conclusions reached by the District Court on the merits of the controversy. After the sale the receiver was discharged, and the trustee took his place, having succeeded to all his rights. An order of the court had directed the disposal of the bankrupt’s estate by public or private sale at the .appraisal. The sale involved in this litigation was…
