1. Appeal and error’: decisions reviewable : order overruling motion to dismiss bill in equity : failure to renew. I. At the close of plaintiff’s testimony, the defendant moved the court to dismiss the bill of plaintiff on four grounds, which amount to an assertion that, upon the evidence of the plaintiff, there is such lack of proof as that the court is not warranted in entering any decree other than a dismissal; and the last ground of the motion asserts there is no evidence that any proof of loss was furnished the defendant.
