The original complaint in this suit was filed by the plaintiffs, Roland T. Marshall (“Marshall”), Paul L. Carson (“Carson”) and Henry T. Jones (“Jones”), as black citizens against the defendant Electric Hose and Rubber Company (“Company”) charging that the Company maintained a policy, practice, custom or usage of discriminating against the plaintiffs and the plaintiffs’ class 1 because of their race or color.
