This case arises out of the plaintiff John Montalbano’s (“Montalbano”) desire for a gun permit. The plaintiff, a former officer with the Port Authority Police Department (“PAPD”), brought this action against the Port Authority and two psychologists employed by the Port Authority, Dr. Doris Francis and Dr. Francine Silver, alleging violations of his constitutional rights under the Second and Fourteenth Amendments, as well as violations of 42 U.S.C. § 1983.
