OPINION
LARKIN, Judge.
In this pretrial appeal, the state challenges the district court’s order granting respondent’s motion to dismiss a charge of driving while impaired. The state argues that the district court erred in concluding that a law-enforcement officer violated the constitutional protections against unreasonable search and seizure when the officer ordered respondent out of a vehicle to investigate whether respondent had been driving while impaired.
