PATTERSON, District Judge.
The libelant was the owner of three lots of cherries carried by the claimant on its ship Ansaldo from Italian ports to New York and *580Philadelphia. It brought suit for damage to the cherries in transit, and prevailed on the merits. By the interlocutory decree the case was sent to a commissioner to ascertain and compute the damages. The commissioner took testimony and filed his report, finding the damages (inclusive of interest) at the figure of $26,006.99. The case is here on exceptions taken by the carrier.
