1. INTRODUCTION
Plaintiff John Hale (“plaintiff’ or “Hale”), a New York state prison inmate proceeding pro se and in forma pauperis, commenced this action on March 19, 2008, pursuant to 42 U.S.C. § 1983 and alleges that defendants — 11 employees of the New York Department of Correctional Services (“DOCS”) — violated his Eighth Amendment rights.
