By motion for judgment, filed May 4, 1983, Dennis K. Lavery sued Automation Management Consultants, Inc. (AMCI), seeking damages for the unauthorized use of Lavery’s name for trade purposes in violation of Code § 8.01-40. Lavery, who was engaged in the business of providing professional consulting services for information systems, complained that on August 31, 1981, AMCI, acting without his knowledge or permission, submitted his name as part of a proposal to provide consulting services to the United States Navy.
