The Ince Nursery Company instituted this suit in the lower court against Y. E. Sams and his co-defendants, and in the petition it is alleged:
That on the 16th day of May", 1913, the defendant Y. E. Sams made and entered into a written contract of agency with it, by the terms of which he premised and agreed to act as the agent of the plaintiff in Seminole county, Okla., for selling and procuring for it orders for nursery sfr-rk, and in consideration of such services said company promised and agreed to pay him for the faithful performance thereof certain commissions of the…
