This is an action in ejectment commenced in the district court of Washington county, on December 6, 1912, by plaintiff in error, as plaintiff, against the defendants in error, as defendants, wherein the petition alleged in part as follows:

“That plaintiff has the legal estate in fee simple and the equitable estate in and to the following described real estate situated in Washington county, Okla., to wit: East half-of the northwest quarter of the. southwest quarter and west haif of the"northeast quarter of the southwest quarter and southeast quarter of the southwest quarter of the northwest…
