Cross appeals from an order of the Supreme *843Court (Donohue, J.), entered March 3, 1997 in Albany County, which, inter alia, denied defendants’ cross motions for summary judgment dismissing the complaint.

While employed as a managing partner for a large accounting firm, plaintiff purchased an executive occupational disability insurance policy from defendant Berkshire Life Insurance Company through defendant Rose & Kiernan, Inc.
