HILL, Circuit Judge:

On September 25, 1986, Homart Development Co. (Homart) filed suit pursuant to federal diversity jurisdiction against Mr. W.T. Sigman. Homart alleged that Mr. Sigman breached a conditional option contract for the sale to Homart of real property that Mr. Sigman owns in Rockdale County, Georgia. The district court granted defendant Sigman’s motion for judgment on the pleadings regarding plaintiff’s action for specific performance of the conditional option contract, actual and consequential damages, and attorneys’ fees.
