OPINION

MURNAGHAN, Circuit Judge:

Kevin DeWayne Cardwell appeals the district court’s dismissal of his petition for a writ of habeas corpus. The appeal presents three questions. First, we are called upon to determine whether the district court erred in denying Cardwell an evidentiary hearing on his claim of ineffective assistance of counsel.
