This case returns to this court after the Supreme Court’s vacatur and remand of Hughes Aircraft Co. v. United States, 86 F.3d 1566, 39 USPQ2d 1065 (Fed.Cir.1996) (Hughes XIII), in light of the Court’s decision in Warner-Jenkinson Co. v.
