Appellant-plaintiff Louisville & Indiana Railroad Company (Railroad) appeals the entry of summary judgment for appellee-defendant Indiana Gas Company (IGC) in the Railroad’s action for trespass, license rent, quantum meruit, and quantum vale-bant.1 Specifically, the Railroad argues that the trial court erred as a matter of law when it held that the deeds made to the Railroad’s predecessors in interest did not provide ownership in fee simple.
