1Opinion of the CourtTruly, J.
On the 23d day of July, 1903, the board of mayor and aider-men of the city of Jackson at a regularly called meeting adopted an ordinance extending the corporate limits of the city. This ordinance was duly published as required by law, but *178before the expiration of thirty days after its enactment certain citizens appealed to the circuit court, protesting against said, ordinance becoming operative. At the ensuing term of the circuit court, when the case came on for trial, the citizens who had appealed moved to strike out the tender of issue which had been made by the attorneys for the city.
