B. F. Brooks- filed this suit in the district court of Potter county to recover damages for injuries alleged to have been received while he was employed in interstate commerce by plaintiff in error. He alleged that the injuries were caused by the negligence of the railway company.
The defendant company, among other pleas in bar, alleged that Brooks’ employment was by virtue of a written contract; that he therein obligated himself to give notice in writing of any injuries and claim *187for damages to the company, within SO days from the time the injuries were received; that, if he failed so to do,…
