YOUNG, Justice.
Appellant’s suit in the trial court was for injuries — a hernia — sustained by him while in the service of appellee Railroad Company as a section hand at. Miller’s Switch, Dallas County; the particular work in which he was engaged on said August 12, 1937, being the lifting of certain iron rails in concert with three fellow employes, by use of a lining bar. Upon a trial to a jury and return of verdict on submitted issues (appellee’s motion for peremptory instruction being denied), both parties filed motions for judgment, appellee’s motion being non obstante veredicto.
