Appellant sought to enjoin the town of Hamilton and its officers who were proceeding to open a street through property in his possession under a claim of ownership. Relief was denied, and he appeals:

R. W. Cashion owned the property in 1898, and in that year offered it at public sale according to a plat showing its division into eight lots. This controversy relates to
