CODY, Justice.

Appellant Johnson brought this suit against appellee Moody in the district court of Harris county to recover damages for slander and false imprisonment.

When appellant, plaintiff in the court below, rested, appellee moved for an instructed verdict; and did so again at the conclusion of the evidence. The court, however, submitted the case to the jury on special issues. The answers on the special issues were favorable to appellant.
