R.K. Harp Investment Corp. v. James McQuade and Donald Cobb, M.D.

Court of Appeals for the Seventh Circuit

Decided July 15, 1987No. 86-2150PublishedCited by 37 opinions

1Opinion of the Court

BAUER, Chief Judge.

The plaintiff-appellant, R.K. Harp Investment Corp. (“Harp”), appeals the district court’s denial of a Rule 11 motion, Fed.R. Civ.Pro. 11, seeking attorneys’ fees in excess of $37,000 from the defendants-appel-lees, James McQuade and Donald Cobb. Harp’s Rule 11 motion was filed following the district court’s denial of the appellees’ motion and subsequent amended motion to set aside a prior default judgment entered in the case. For the reasons which follow we affirm the district court’s denial of Rule 11 sanctions.
