This proceeding was commenced by the filing in this court, in pursuance of leave granted for that purpose, of the petition Of Scott Bibb for a writ of mandamus commanding the mayor and common council of the city of Alton to admit Minnie Bibb and Ambrose Bibb, children of the relator, to the Washington school, or the most convenient of the public schools of the said city to which they had a right to be admitted, without excluding them, or either of them, on account of their color or descent.
