Mrs. Mollie D. Abernathy, joined by her husband, M. G. Abernathy, on June 7, 1927, filed this suit in the Ninety-Ninth judicial district of Texas, praying for an injunction to restrain the sale of lands belonging to Mrs. Abernathy in Lubbock county, Tex., for taxes alleged to be due appellant." The Lubbock independent school district and H. L. Johnston, the sheriff of Lubbock county, were made defendants therein. The judge of said.
