On March 24, 1928, Dr. W. A. Dupree was killed in a collision between a Ford truck in which he was riding and a freight train operated by the Atchison, Topeka Santa FE Railway Company on the track of the Rio Grande, El Paso Santa Feacute Railroad Company.

This suit is by the appellee, Mrs. Dora Dupree, surviving wife of the deceased, suing in her own behalf and as next friend for her two minor sons, against the companies above named, to recover damages for the alleged negligent killing of her said husband.
