By THE COURT.

This is an appeal on questions of law and fact from an injunctive order against defendants-appellants. The form of the appeal requires that we consider and determine the issues as though the case originated in this Court.

Plaintiff corporation was engaged in the business of transporting material and merchandise and at the times involved in this suit was delivering gravel and dirt to the site of the Tuberculosis Hospital Health Center Building then being constructed at the Ohio State University.
