A general statement of the situation will probably be necessary to an understanding of the matters involved herein.
In July, 1922, the city of Waukon entered into a contract with Thomas Carey & Sons for the construction of certain pavement and other public improvements in the said city of Waukon. The Eclipse Lumber Company furnished material to the contractor in an amount of approximately $13,000.
