When the appellant had closed his case and rested on the trial in the court below, the respondent moved for a nonsuit upon the grounds: 1st. That the plaintiff had not shown that he had a judgment which was a lien or charge upon the land, nor had he shown that he redeemed or attempted to redeem the same. 2d.
